1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Kayla Homenok (“Company,” “we,” “us,” or “our”), concerning your access to and use of the kaysthetics3000.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). We are registered in Canada and have our registered office in Montréal, QC, Canada.

By accessing or using the Site, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with all of these Terms, you must discontinue use of the Site immediately.

Supplemental terms and policies may be posted on the Site from time to time and are expressly incorporated herein by reference. We reserve the right to modify these Terms at any time. Updates will be reflected by the “Last updated” date above, and your continued use of the Site constitutes your acceptance of the revised Terms.

The Site is not intended for use in jurisdictions where such use would be contrary to law or would subject us to additional registration requirements. You access the Site at your own initiative and are responsible for compliance with applicable local laws.

All users who are minors (under 18) must have parental or guardian permission to use the Site.

16. RETURN AND REFUND POLICY

Digital Products

All sales of digital products are final and non-refundable. Due to the nature of digital downloads, once files have been delivered, no refunds, exchanges, or cancellations will be provided.

If you experience an issue with your order—such as receiving the wrong file, a corrupted download link, or technical difficulties—please contact us within 7 days of purchase at hello@kaysthetics.com. We will gladly assist in resolving the issue or provide a replacement file if applicable.

All digital products are delivered electronically. No physical items will be shipped unless explicitly stated in the product description.

Physical Products

For physical items (such as stickers, prints, or other tangible goods), we accept returns only for products that arrive damaged or defective.

To request a refund or replacement, please email hello@kaysthetics.com within 7 days of delivery, including:

  • Your order number,

  • Clear photos of the damaged item, and

  • The original packaging (if applicable).

Once approved, we will issue either:

  • A replacement (subject to availability), or

  • A refund to your original payment method.

Returned items must be unused and in their original packaging. We reserve the right to deny refunds for items showing signs of use or damage after delivery.

Shipping fees are non-refundable, and customers are responsible for return shipping unless the item arrived damaged or defective.

17. SHIPPING POLICY

We offer shipping across Canada, the United States, Europe, and select international destinations. All orders are processed and shipped from Montréal, Québec.

Processing time: Orders are typically prepared within 2–5 business days. You’ll receive a confirmation email once your order has shipped. Please note that delivery times may vary depending on location, customs delays, or postal service disruptions beyond our control.

Shipping rates & free shipping thresholds:

  • Canada & USA: Free shipping on orders over $75 CAD (≈ $53 USD).

  • Europe: Free shipping on orders over $100 CAD (≈ €61).

  • Québec: Free shipping on orders over $75 CAD.

  • Other international destinations: Shipping rates are calculated at checkout based on your location.

Shipping thresholds are applied automatically at checkout based on your delivery country.

Customs & duties: For all orders shipped through Canada Post, duties and import fees are fully covered by us — you won’t pay anything extra upon delivery. For international courier services outside of Canada Post, customers are responsible for any applicable customs fees or VAT.

Lost or delayed mail: Once an order has been shipped, delivery times are beyond our control. If your order appears lost or delayed, please contact your local postal service first, then reach out to us with your order details — we’ll do our best to help.

18. GOVERNING LAW

These Terms are governed by the laws of Canada. You agree that any disputes shall be resolved exclusively in the courts of Canada.

19. DISPUTE RESOLUTION

You agree to submit all disputes to the jurisdiction of the Canadian courts. We reserve the right to bring proceedings in your country of residence or principal place of business.

20. CORRECTIONS

We may correct any typographical errors or inaccuracies on the Site at any time without notice.

21. DISCLAIMER

The Site is provided “as is” without warranties of any kind. We make no guarantees regarding accuracy, reliability, or uninterrupted availability. Use of the Site is at your own risk.

22. LIMITATIONS OF LIABILITY

We shall not be liable for indirect, consequential, incidental, or punitive damages arising from your use of the Site. Our total liability shall not exceed $100 USD.

23. INDEMNIFICATION

You agree to indemnify and hold us harmless from any claims arising from your use of the Site, your breach of these Terms, or your violation of any rights of a third party.
