1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Kayla Homenok (“Company,” “we,” “us,” or “our”), concerning your access to and use of kaysthetics3000.com, including any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”).

We are registered in Canada, with our registered office in Montréal, Québec, Canada.

By accessing or using the Site, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions. If you do not agree with all of these Terms, you must discontinue use of the Site immediately.

Supplemental terms and policies may be posted on the Site from time to time and are expressly incorporated herein by reference. We reserve the right to modify these Terms at any time. Updates will be reflected by the “Last updated” date above, and your continued use of the Site constitutes acceptance of the revised Terms.

The Site is not intended for use in jurisdictions where such use would be contrary to law or would subject us to additional registration requirements. You access the Site at your own initiative and are responsible for compliance with applicable local laws.

16. RETURN AND REFUND POLICY

Digital Products

All digital product sales are final and non-refundable. Due to the nature of digital downloads, refunds, exchanges, or cancellations are not available once files have been delivered.

If you experience a technical issue (incorrect file, corrupted download, or access issue), please contact hello@kaysthetics.com within 7 days of purchase. We will gladly assist or provide a replacement file if applicable.

Digital products are delivered electronically. No physical items are shipped unless explicitly stated.

Physical Products

For physical items (including stickers, prints, or other tangible goods), returns are accepted only if items arrive damaged or defective.

To request a refund or replacement, please email hello@kaysthetics.com within 7 days of delivery, including:

• Order number

• Clear photos of the damaged item

• Original packaging (if applicable)

Approved claims will result in either a replacement (subject to availability) or a refund to the original payment method.

Items must be unused and in original condition. Shipping fees are non-refundable. Return shipping is the customer’s responsibility unless the item arrived damaged or defective.

17. SHIPPING POLICY

We ship to Canada, the United States, Europe, and select international destinations. All orders ship from Montréal, Québec.

Processing time: Orders are typically prepared within 2–5 business days. Delivery times may vary based on location, customs, or postal service delays.

Free shipping thresholds:

• Canada & USA: Free shipping on orders over $75 CAD

• Europe: Free shipping on orders over $100 CAD

• Québec: Free shipping on orders over $75 CAD

Shipping thresholds are applied automatically at checkout.

Customs & duties:
Orders shipped via Canada Post include customs and import fees at no additional cost. For international courier services outside Canada Post, customers are responsible for any applicable duties or VAT.

Lost or delayed mail:
Once shipped, delivery is outside our control. If your order appears delayed or lost, please contact your local postal service first, then reach out to us for assistance.

18. GOVERNING LAW

These Terms are governed by the laws of Canada. Any disputes shall be resolved exclusively in Canadian courts.

19. DISPUTE RESOLUTION

You agree to submit all disputes to Canadian jurisdiction. We reserve the right to bring proceedings in your country of residence if necessary.

20. CORRECTIONS

We may correct typographical errors or inaccuracies on the Site at any time without notice.

21. DISCLAIMER

The Site is provided “as is” without warranties of any kind. Use of the Site is at your own risk.

22. LIMITATION OF LIABILITY

Our total liability shall not exceed $100 USD. We are not liable for indirect, incidental, or consequential damages.
